1. Introduction

Welcome to Nivi 91. These Terms and Conditions ("Terms") govern your use of our website (www.vinaypgs.in) and your rental agreement with us. By accessing our website or entering into a rental agreement with Nivi 91, you agree to be bound by these Terms.

2. Website Terms of Use

2.1 Acceptable Use

You may use our website only for lawful purposes and in accordance with these Terms. You agree not to use our website:

• In any way that violates any applicable national or international law or regulation
• To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
• To impersonate or attempt to impersonate Nivi 91, a Nivi 91 employee, another user, or any other person or entity
• In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful

2.2 Intellectual Property

The website and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Nivi 91 and are protected by copyright, trademark, and other intellectual property laws.

3. Accommodation Rental Terms

3.1 Eligibility

Our accommodation services at Nivi 91 are exclusively for female students and working professionals aged 18 years and above. By booking accommodation with us, you confirm that you meet these eligibility criteria.

3.2 Booking and Payment

• Monthly Rent: ₹18,000 for single occupancy
• Security Deposit: ₹20,000 (refundable upon satisfactory completion of tenancy)
• Food (Optional): ₹2,500 per month
• Payment Schedule: Rent must be paid on or before the 5th of each month
• Late Payment: A late fee of ₹500 will be charged for payments made after the 5th of the month

3.3 Notice Period

A minimum of 30 days written notice is required from either party to terminate the rental agreement. Notice must be given in writing via email or WhatsApp.

3.4 Security Deposit Refund

The security deposit will be refunded within 15 days of vacating the premises, subject to:

• No damage to the property or furnishings
• All outstanding rent and utility bills are cleared
• Proper handover of keys and room in clean condition
• Completion of minimum stay period as per agreement

4. Property Rules and Regulations

4.1 General Conduct

• Respect quiet hours between 10 PM and 7 AM
• Keep common areas clean and tidy
• Visitors require prior notice to management
• Male visitors are not permitted inside the premises
• Maintain hygiene standards in shared spaces

4.2 Prohibited Activities

• Smoking, alcohol, or drugs are strictly prohibited on the premises
• Pets are not allowed
• Subletting or sharing your room with non-residents is not permitted
• Loud music or disturbances that affect other residents
• Illegal activities of any kind

4.3 Safety and Security

• CCTV surveillance is in place for security purposes
• Gate closing time is 10:30 PM (late entry requires prior permission)
• Do not share keys or access codes with non-residents
• Report any suspicious activity to management immediately

5. Amenities and Services

5.1 Included Amenities

The following amenities are included in the monthly rent:

• Fully furnished room (bed, wardrobe, study table, chair)
• Attached bathroom with geyser
• High-speed WiFi
• Power backup
• 24/7 security
• Daily housekeeping
• Access to common areas (kitchen, TV room)

5.2 Optional Services

• Food service: ₹2,500 per month (breakfast, lunch, and dinner)
• Laundry service: Available at additional cost

5.3 Maintenance

We are responsible for maintaining the property and ensuring all amenities are in working condition. Any maintenance issues should be reported to management promptly. We will make reasonable efforts to resolve issues within 48 hours.

6. Cancellation and Refund Policy

6.1 Before Move-in

• Cancellation more than 15 days before move-in: Full refund of advance payment
• Cancellation 7-15 days before move-in: 50% refund of advance payment
• Cancellation less than 7 days before move-in: No refund

6.2 After Move-in

After moving in, the standard 30-day notice period applies. Rent for the notice period must be paid in full. The security deposit will be refunded as per the terms mentioned in section 3.4.

7. Liability and Damages

7.1 Resident's Liability

Residents are liable for any damage caused to the property or furnishings beyond normal wear and tear. Repair or replacement costs will be deducted from the security deposit.

7.2 Personal Belongings

Nivi 91 is not responsible for loss, theft, or damage to residents' personal belongings. We recommend residents maintain their own insurance for valuable items.

7.3 Limitation of Liability

Nivi 91 shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

8. Privacy and Data Protection

We respect your privacy and handle your personal information in accordance with our Privacy Policy. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

9. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify current residents of any material changes via email or notice posted in common areas. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, and specifically the laws applicable in Karnataka.

10.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or your tenancy shall first be attempted to be resolved through good faith negotiations. If negotiations fail, disputes shall be subject to the exclusive jurisdiction of courts in Bangalore, Karnataka.

11. Termination

We reserve the right to terminate your tenancy immediately without refund if you:

• Violate any of the property rules mentioned in section 4
• Engage in illegal activities on the premises
• Cause significant damage to the property
• Consistently disturb other residents
• Fail to pay rent for more than 10 days after the due date

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

14. Entire Agreement

These Terms constitute the entire agreement between you and Nivi 91 regarding the use of our website and services, superseding any prior agreements between you and Nivi 91 relating to your use of the website or services.
